Legal Question in Wills and Trusts in New Hampshire

My sister left her personal property to me in a will but now the executive of the will is saying that she gave her the property before she died. I am now being told by my attorney that I need to prove that my sister didn't give them to her. Is this true? I thought what was left in a will to a person went to them. I know my sister didn't do this as the things she is saying my sister gave her are the same exact things she already has. What do I do, just pay the fee and not get what my sister wanted me to have.

You certainly have a right to contest the will but whether it is worth it will depend upon the value real or sentimental of the property. It is not uncommon for people to leave something in the will to a person but have given it away to someone else before dying. What is odd is that she gave this to the attorney and the attorney did not make some kind of record to explain why she was getting it when it was mentioned in the will.
