Legal Question in Bankruptcy in New Jersey

Erasing Bankruptcy from Credit Report

I co-signed for my mother four years ago, so that she could refinance her car. A couple month after I moved to Puerto Rico and was not in contact with her in any form. Two years later I came back to new jersey to find out that she had filed bankruptcy and that the account which i co-signed for was put in the bankruptcy. Because of this now my credit is ruined. Everytime I applied for a credit card I'm denied. The reason that shows up in the credit report is bankruptcy. Which I never filed. I'm a little confused,

Is there anyway that I cant get the bankruptcy to be removed from my credit report? Fix it somehow? I'm trying to buy a new car. If it wasnt for the bankruptcy showing up my credit would be perfect.

Re: Co-signer obligation

The problem does not appear to me to be the bankruptcy; it appears to me that your problem is as a result of the non-payment of the car debt. She filed bankruptcy and therefore she is no longer obligated. You, as the co-signer, are now obligated on the debt. If you pay it, that should clear up your credit problem. You may think that it is unfair that you are required to pay for your mother's debt. Actually, it is quite fair. The only reason that company gave your mother credit was because of your good credit and the fact that you stated, by signing the guaranty, that you would pay if she did not. That day has now come. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, you may want to contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010. Mention Law Guru and your first consultation is free. Good luck!
