Legal Question in Business Law in New Jersey

1) My company is IT consulting company registered LLC in NJ and have a office in New Jersey but currently I am living in Maryland; Nature of the business is computer consultants will work in different client companies in different state and will be living there. I get to take 10% of his total bill he charges to the client.

I remember reading somewhere that any profit that my I make from selling my service to outside state I will not have to pay tax for it. Because the income came from outside of NJ, Is it true?

2) When I hire consultant in 1099 basis - Do I have to pay any tax or I can just keep my 10% share from the money that I receive from client company and rest of the money I can pay my consultant assuming he will take care of his taxes.

3) I myself also working through my company; As far as I know I have to report my taxes to IRS every quarter, my question is : Can I report my expenses like driving to work (gas)? by the way I commute almost 3 hours every day to work.

4) If my consultant work as W2 in my companies payroll what is the percentage of my tax liability and what is the percentage of consultants liability?

5) As I mentioned above my company is registered in NJ; If I have office in New York and Maryland will this have any effect on the business tax. And also I may have to sponsor some non-immigrant worker for H1B visa. Will the multiple office be a problem for H1B visa application?

Your questions are very important and fairly typical. I suspect that you will have many other similar issues throughout the course of your business operations. I recommend that you seek out and retain a qualified CPA. I can recommend one if you call me (973-921-0600). Your immigration question seems straightforward as well, but it's outside my practice area. If you don't get the answer, I can refer you to an immigration attorney, too.
