Legal Question in Business Law in New Jersey

Didn't file sales and use tax returns

Hi,

In 2003, I registered a trade name in Bergen County, but never commenced business, either then or now. It was just an idea I had but never went through, and I never dissolved it or anything.

I got a letter from the NJ Tax Amnesty program saying that I had never filed sales and use tax returns going back every quarter to 2003.

What should I do? I spoke to the operator at the tax amnesty hotline who said to just send a letter mentioning this.

In the letter should I just basically explain this as simple as possible, saying, ''I never commenced business, so no returns needed to be filed.'' ?

Is there something specific I should say?

Thanks

Re: Didn't file sales and use tax returns

A letter explaining that the business has been inactive and conducted no sales since its inception should be sent to both the Amnesty address and also the Sales and Use Tax Department of the NJ Department of the Treasury. This should correct the situation. Bottom line and worst case scenario is that all missing returns will be requested, and all should be zeros.
