Legal Question in Credit and Debt Law in New Jersey

Personal Property

I was terminated from my part time job. I e mailed my former employer about requiring my personal belongings from the work place and I was told she would drop them at my house. My belongings were never returned to me so I went to my employer at the workplace and I was told that another employee had thrown my belongings away. I waw wondering if there was any way I could be compensated for my lose.

Re: Personal Property

You can file suit in Small Claims court against your former employer for the economic value of your belongings. Your first step should be to make a list and determine what these items were worth. If it is worth the trouble, the court in your County can help with the forms.

Your legal theory will be that your employer became a bailee of your property when you asked for it and were told that it would be delivered to you. A bailee is a person who has possession of property, but not title to it. A bailee has the legal responsibility to exercise reasonable care to protect the property.
