Legal Question in Criminal Law in New Jersey

Reconsideration after plea bargain

My nephew is about to agree to a plea bargain for 4 bank robberies. They offered 10 years at 85% (we live in New Jersey). Will he be able to come back in a couple of years and ask for reconsideration of his sentence or will he have to serve the entire 85% of the 10 years?

Thanks for your help.

Re: Reconsideration after plea bargain

He'll have to do the 8 1/2 years. There is generally no follow up motions like this, at least not in this case.

He will not be eligible for parole for 85% of his sentence and in a couple of years you will not be able for apply for reconsideration of his sentence.

Call me if you like.

Re: Reconsideration after plea bargain

He must already have an attorney, so he should ask that attorney for a better explanation of the plea bargain before he enters into it. There is one provision in the law that allows a rehearing on the sentence but only if the person is extremely sick to the point of death. I have done those types of motions in the past. I am an attorney who has handled many cases similar to yours in various courts throughout New Jersey in the past. Please contact me to discuss your case in more detail. I never charge for simply talking to a person about their case. Thank you.
