second or third affense

a friend of mine was convicted of dwi in 1985 and again in 1994 and was caught again in 2002 in a school zone and on the revocked list he goes to court in feb 2003 what is he facing

He is facing A LOT! If convicted, he would be a third offender. If convicted under the school zone law, he is facing 20 years loss of license, significant jail time, and other penalties.

Please MAKE SURE that he is represented by an attorney that goes to trial in these cases, that prepares these cases for trial. The last thing he needs is someone to charge him a bargain price to just walk in and plead him guilty.

Also, he should be looking to challenge one or both of the prior convictions through "Post Conviction Relief". If he is successful in doing that with either conviction, then, if convicted in this matter, he would be considered a second or first offender.

He is in very serious trouble and could possibly go to jail for up to 6 months. He should defintely get a lawyer. If he cannot afford one, ask the Judge for a Public Defender or other attorney to be appointed. If he wants his own attorney, it will probably cost about $3,000 to get one.
