Legal Question in DUI Law in New Jersey

Alcotest Independent Testing

What do all of you attorneys think now that Base One has tested that piece of crap and found the thousands of errors, antiquated technology, etc.? Could the supreme court possibly continue to use this machine? Apparently, they could be putting drunks back on the road for blowing 0.00 and convincting truly innocent people. Many police I have spoken to who were adamant before of the greatness of this machine, seem to be much less enthusiastic now. Interested in all of your opinions. FYI, Evan Levow and the others should be applauded for their efforts in this matter.

Re: Alcotest Independent Testing

First, yes, Evan is great, no doubt about that, as is Mel and everyone else fighting the good fight on this issue. With regard to my opinion or anyone's opinion, I don't really think they would mean anything. You know what they say about opinions. I look at it this way, can you imagine the backlash if everyone that plead guilty with a Chun stip just went free? That is thousands of people at this point. It would be a nightmare. My guess is that they will admit it with certain conditions or after they fix something or other. Then, everyone that has the Chun stip can take back the plea and start from square one. But then again, who would have thought that the NJSC would have thrown out presumptives in Natale?
