alcotest ruling state vs. Chun

I was given a DUI in May of last year, I blew a .12 on the alcotest my case has been stayed. I know the ruling came out today that the machine was accurate is there a chance of me getting the .08 to .10 penalty? Also I wasnt driving when I recieved it and they didnt witness me driving but in the report the cop said I admitted operation, my lawyer said there is nothing I can do about that is that true?

.12 is pushing it, but I think there is still a chance to push it below .10. Some lawyers have a defeatist attitude. There is always something you can do. Trials are meant to be won. I have an office in Toms River so feel free to give me a call.
