Legal Question in DUI Law in New Jersey

Chun Decision

Upon discussion between my attorney and prosecutor, I was offered 7 months (DUI was over 1.0) to plead guilty. I did, but the pros. also allowed a ''stay if requested,'' per pending Chun decision. Does previous plea now stick unchanged or can I revisit the case? I don't understand how I can plead guilty AND get a stay.

Re: Chun Decision

The Supreme Court allowed Defendants to enter conditional guilty pleas to DWI pending the Chun litigation. The Court Ordered however, that sentences be stayed pending the decision. That means that if you have a right to re-open or vacate the plea if there are issues that might cast doubt on the integrity of the Alcotest readings.
