As I understand it, the answer is yes, your attorney is required to appear with you. However, some mun icipal court judges are not enforcing that requirement. Your attorney should be reviewing your file to see if all the requirements of the Supreme Court's decision in State v. Chun have been met, including the accuracy of the readings. As far as additional fees, that is between you and your attorney. Some attorneys advised their clients at the time of the original plea was made, that additional fees may be charged if they were required to make another appearance.
