Legal Question in Family Law in New Jersey

401k, retirement and other funds

I have documentationn of what moneys in my spouses 401k and cash value in an insurance fund really is.

If my spouse transfer moneys out of both of the above acounts can I produce my documentation to show what the true value is before the transfer took place and shouldn't I be entitled to 1/2 of the true amounts before the transfer took place. Also, I know my spouse has a retirement fund. Am I not entitled to a portion of that as well?

Re: 401k, retirement and other funds

Thank you for your inquiry.

You should definately be able to argue that you should receive half of the value prior to the unilateral transfer.

It would be my pleasure to speak to you about your potential divorce. Accordingly, please feel free to contact my office at 732 246 0909 to discuss further.

Very truly yours,

Edward R. Weinstein
