Legal Question in Family Law in New Jersey

New day care costs

My children are 9 and 5 years old and live with their mother. She used to run a day care business to produce her income. She recently decided to change careers to increase her income and now pays $210.00 per week in day care expenses. Am I required to subsidise her career decisions ? If so , should I wait for a court decision before I pay any share ?

Re: New day care costs

hi -

it depends on what any prior court orders say about the daycare issue. if there aren't any , and if she files for daycare contribution from you, you could be required by the court to pay some percent of the work-related daycare costs. feel free to call me at 609 263-0089 if you have any further questions. good luck !!

Re: New day care costs

Your obligation is to continue to pay the amount of child support as Ordered by the Court until that order is changed. Presumably, she will need to make an application to try to get you to pay toward the child care. It will then be hashed out either by negotiation between attorneys or decided by a Judge. In the meantime, just pay your regular support order. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since you have not retained an attorney in this case, before you take any further action, you should contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010. If you mention LawGuru, there will be no charge for your first consultation. Good luck! Rob Gleaner
