Legal Question in Family Law in New Jersey

In A divorce can my credit be be seperated from husbands

My husband had a job that put him on call 24 hours a day and no set hours ever so i was not really able to persue a real career(children). The problem is he controlled all of our finances and I didnt even have my name on any bank accounts, and I didnt even have a check book.Well he destroyed our credit, our home was forclosed and apparently he even filed bankruptcy twice before with out my knowledge. My car was repossed all utilites shut off and owed to,,credit cards, etc.He developed a very bad gambling and womenizing problem. Now I would like to start my life but I cant even get an apartment in a decent area because of credit, never mind a mortgage ever. Can a judge seperate my credit from his since he did not let me have access to our finances?

Please be advised that I have not been retained to represent you and I am basing this response on the limited amount of information supplied. However, your question is very general and i would need more specifics to answer it properly. With some debts, especially credit cards, if your husband's name is the only name on the account, he is the only person liable. With other marrital debts, this is not always the case. If you are still married but filing for divorce, you should get a separation agreement in place ASAP and separate your finances so that you incur no further debt. There are likely things which can be done to assist you and if you would like to provide further details and discuss this matter, I can be reached at 908-537-7975.

GOOD LUCK

Thank you for your e-mail. Your question is rather complex and fact-sensitive. Further, it is not clear from your message if you are already divorced, or have not proceeded yet. I strongly advise you to seek the assistance of legal counsel to personally review your issues and advise you appropriately. Our firm has a dept of experienced family law attorneys who are available to guide you and provide representation. Please call 856-795-6700 to arrange for a consultation. K.R.Scheiner
