Fathers Child Support Rights

My Step son just turned 18. He dropped out of school at 16 and right before his 18th birthday and child support to stop, he is suddenly in school getting his GED. Can his Father contest the continuation of Child Support although he is attending school for 15hrs a week?

Hi:

This answer depends on what your husband agreed to and was part of the settlement in his prior marriage, and how a judge will look at the facts and circumstances.

Your husband can contest the child support but he should speak to local counsel.

I think he can because the child really should have been emancipated at 16 in my opinion.
