Re: Interim Counsel Fees ?\nCan I petition the Court for Interim Counsel Fees for my impending divorce? Although I am currently working, I have declared bankruptcy, my home is in foreclosure, and I have borrowed money from relatives for an attorney to date. I do not own anything (other than the furniture in our home)! Wife has refused mitigation to date and has rejected every reasonable offer regarding visitation &/or alimony. Appears determined to go to trial and run up counsel fees. While she has a Master\'s Degree in Education, claims she cannot find job and is using her \"inheritance\" for her counsel fees. Can I be awarded interim counsel fees if this case goes to trial so that I can be on equal footing with her?

You can ask for counsel fees pendente lite, pending the outcome of the case, based on you wife's ability to assist you with same. Your chances of succerss are not exactly overwhelming, but there is a chance of success.
