Is it possible to move the jurisdiction of a child support case from NJ to NY? If so what criteria would need to be met? My husband's children live in NJ he lives in NY.

The location of the children is the usual site for any such matter. Under the Interstate compact - any Orders or Agreements in NY can be transfered to NJ and be given full force and effect. Good luck!

It is possible for the jurisdiction to change

This is discretionary with the Court, and,

in most instances, also requires the permission

of the jurisdiction "giving up the case"

The more important question is "why"

Under the Uniform Enforcement of Child Suppoort

Acts, which are in effect in every

jurisdiction due to the requirements of

federal funding, there is usually no

monetary advantage to be gained once a

child support order has been entered

And such Uniform laws also permit enforcement

and testimony without travelling back and

forth

The real question is "what is the purpose

you ultimately wish to accomplish"

In most cases the court will uphold a petition for a support case dependant on your residence or childrens, but if you dont have a problem with commute to the city for every court appearance you can file a petition for support in New York. Most people prefer to file in their childs county and ask that the other travel to, or reply to that court order.
