Legal Question in Family Law in New Jersey

My unmarried partner and I have been together since 2004. We moved in together on 2005. In September 2005 I left my job to raise our child. We since had two more children together. Are agreement was that he would provide financially while I provided home care for the children and the house. We have shared finances. Since I have not been working but providing at home care and he has been providing financially since 2005 am I entitled to a division of retirement assets and palimony since we are splitting up? Is it fair that he walks away with a huge pension and I have nothing? We are not married but in a "marriage-like" relationship.

Unfortunately, that is the result when you are not married. Palimony now requires a written agreement. You are certainly entitled to child support and a share of the value of any jointly held assets. But marriage has certain advantages (and some disadvantages) that unmarried relationships do not.

Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. You will only be able to rely on advice from an attorney who you have actually retained. Good luck! Rob Gleaner
