Legal Question in Medical Leave in New Jersey

Family Leave if Company Taken Over

I am due to have a baby May 21 in a large company I worked in for a year and a half. Found out my division of the company is up for sale, and might well be sold prior to my leave or during my leave. Supposed to receive 12 weeks paid (and full benefits) combination of vacation accrued, vacation advance for year, disability (state and company insurance), sick days, paid week from company, etc. Will I lose all my pay, benefits & vacation time if company is taken over? Can they just fire me? Is it different if happens before or during my leave? Does my current company have to give me any severance? Thank you.

Re: Family Leave if Company Taken Over

This is a complex set of facts and the answer is very dependent on details (which you have not provided).

We had a very similar case last year and were able to advise the client to maximize her rights and recovery. But careful planning is necessary because the 2 companies will have experienced counsel advising them. You should contact an attorney at once.
