Dv 2005 and sec 245i

Hi,

I recently won the DV 2005 lottery. I have overstayed my FI status since 2000. I am married, my husband had filed a labor petition before April 2001, it was denied due to visa overstay of more than 180 days. Can I apply for green card with the DV 2005, since my hus is 245i eligible? Where and when can I file. He has the original INS documentation to show that the case was filed and denied. Am I 245 eligible too? Can I apply for him too?

I am abit confused about 245i eligibility please help.

Yes, you can apply for a green card because your husband is eligible for 245i.

You can file at the local immigration office.

You are 245 eligible too. You can apply for him too.
