Legal Question in Immigration Law in New Jersey

H1 ,H4 status

Hi

I need help in my case.Please let me know how you can assist me. My husband was on h4 and later got h1 from my company which is now out of business and he has not started working from the day of approval.he applied for socail security and its still not received.I have swtiched to new employer and have received my receipt.Please advise me if I should file his H4 or can do h1 without paystubs giving reasons for company not in business.I need your assistance to find a way and file the appropriate.

Dear Maam,

It appears as if the problem should be fixable. As long as you were working in H-1 status during the time that your husband was changing from H-4 to H-1 we should be able to correct his immigration status issues. However, we will need to ask them to apply it retroactively. We have had numerous cases such as these and have been successful with them.
