I'm employed in the state of NJ by a company whose head quarters are in VA. can they do random drug testing if I'm not a board of education employee

Since you are a NJ employee, the answer to your question is controlled by NJ law. There is no hard and fast rule for drug testing of current employees in New Jersey. The factors to be considered in determining if a drug testing program is appropriate in the case of private employment is set out in Hennessey v Coastal Eagle Point Oil Co., 129 N.J. 81 (1992).
