Do you know what the previous employer actually said? If so, was it truthful? A poor reference is not, per se, defamatory as long as it was truthful or based on a reasonably held opinion or belief. If you believe your former employer deliberately lied or was recklessly careless with the truth (i.e. said things that he/she knew or should have known were false) and you suffered a loss because of this, you should discuss the matter with an attorney who can advise you on possible remedies.
