Legal Question in Employment Law in New Jersey

Im in the US on a work Visa (H1B), my employer provides health benefits to all employees and their spouses, but they are not providing to my spouse saying that she does not have a SSN, she is in the US legally on a H4 visa and is not going to have one until someone employs her.

The company that provides health insurance does need my spouse to have SSN, it is my employer who is not willing to do it.

There are thousands of people like me in the US who have health insurances for their spouses.

Is it legal for my employer to not provide health insurance to my spouse?
