Evicting a tenant

Question: What is the procedure of evicting a tenant that is living on a month to month basis with no contract?Also how many months or days are we required to give them ?

Does this answer also pertain to New Jersey? If not what legel rights do we have. We rented our house to a couple who the Husband was a friend of ours at a very low rental rate $600 per month in this areas all houses the going rate is $1000 and up per month. The couple caused a few disturbances ,she had a restraining order and he finally moved out. Now we want the house back to rent it in relation to the proper fees in this area. We also need to do some refurbishing.

Larry:

New Jersey Law is completely different than the California Law you cited. No prior notice is required by law to commence eviction proceedings against a tenant for non payment of rent. If you simply want to evict the tenant because the rent you agreed to accept is too low, that is not permitted whatsoever as the tenant is protected by the Anti-Eviction Act, NJSA 2A:18-61.1.
