Can a landlord sue a persons estate for remainder of the lease after person has died?

Most residential leases can be terminated upon forty days notice to the landlord after the death of a tenant or spouse. The statute provides that the termination is only effective if the rent is paid up to that point. So, if the tenant's estate fails to bring the rent up to date, the termination is ineffective and the landlord can sue for the full balance of the lease.
