Legal Question in Landlord & Tenant Law in New Jersey

my old tenant filed a small claims summons against me because i refused to return their security deposit. i arrived on the court date fully prepared to defend my case in withholding the deposit however, the plaintiff did not make an appearance, causing the case to be dismissed. now, ive received another summons for the same reason. how many times can they continue to do this? i have to miss work again for this pettiness...this is for new jersey.

Move to have the case dismissed or, in the altermative, to have the plaintiff compensate you for the value of your time.

I would agree with counsel. The prior dismissal was without predjudice and not on the merits. Contact me if you want to discuss the matter
