i have a tenant living in the basement and has not paid rent in 4 months. what can i do to make him move since i don't want to get in trouble for renting the basement

If you are renting an illegal premises you will be forced to pay the tenant 6 months rent as a moving expense in order for you to get a court ordered eviction. The only possible way around it is to file a wrongful detainer case and that could take several months and cost much more then an eviction case to process.
