Legal Question in Personal Injury in New Jersey

I was hit by a drunk driver in 2008,Since that time I have had 2 arthriscopic surgeries on my knee and when that did not work a total knee replacement. The drunk driver has his own buisness and has a 1 million dollar insurance policy. I was told that if I do not settle this with the Insurance Company and it goes to trial,the Insurance Co. would say that the accident was his fault without the jury knowing why. They would never hear that he was drunk. Is this true ??
