Legal Question in Personal Injury in New Jersey

Is there a statue of limitations involving a citizen complaint involving a motor vehicle accident in NJ? No police summons were issued, but he filed one against me on day 28 after the accident. By the time I received on day 31 (a monday) and counter filed with the same charge the next day (tuesday) it had been 32 days. We were both arraigned and pleaded not-guilty, but if he gets a lawyer and quotes the statue, will my complaint against him be dismissed? BTW, the charges we both filed are; leaving the scene 39:4-129B. If you can answer this one question, it will help me greatly. Thanks!!

The period during whichl a motor vehicle summons must issue varies, depending upon the offense charged. Thirty days is the shortest time period. For more serious motor vehicle offenses the statute of limitations is usually one year.
