Legal Question in Real Estate Law in New Jersey

My husband signed a preliminary contract to buy a house in italy. he then changed his mind and we stopped payment on the check.($3,000) the builder says he will take legal action against us. we live in the usa. Here I believe we have right of recision. Wouldn't this carry over to this transaction? There is nothing on the prelim. contract stating that we paid the money. Just that we promise to pay half of the amount of the total charge by nov. 11. We stopped payment about 3 days after the check was given in.

This matter would most likely be decided under Italian law since the land is located there and the contract is to be performed there. The three day attorney review period applies to New Jersey transactions where the contract form has been prepared by a broker.
