Oil Tank

Our oil tank was on our neighbors property when we purchase our house. Also, when she purchased the house before us. We want to have it removed. She will not give permission. Who owns it. Who is responsible?

You need to be very careful with this issue because there is a possibility of future environmental damage and you do not want to be left holding the bag. There are both legal and engineering issues. Your best course of action is strongly influenced by whether the tank is completely on your neighbor's land or only partially on it.

I have read what the other attorney wrote, and John is as usual quite correct.

You need a lawyer's advice before you do anything. There is a real risk of huge expenses. The worst home oil tank I ever dealt with cost about $22,000 to clean up the mess, oil leaking into the ground. Nasty.
