Tenants don't payme the rent

Hello, I have this new tenants, since January '02, they always pay me the rent late, So i did not like it that way, So I asked them to leave, we do not have any contract. And now this month of may, they do not want to pay just because we told them to go, now we give them the rigth time (law) 90 days to move, but they told me that they won't pay the rent, because that money they going to use for the security of the other house, so i'm stock, because i have mortgage to pay. What I should do, where i should go????

You can serve a Notice to Cease upon them for violation of NJSA 2A:18-61.1j which provides that habitual late payment of rent is grounds for eviction. You MUST consult a competant attorney to assist you. Contact me if I may be of assistance.
