Legal Question in Sexual Harassment in New Jersey

My 13 year old daughter was forced to take a photo of her breasts by a boy in her school. The Police are handling that matter because he sent the photos all around the school. I do not want my daughter back in that school feeling unsafe, or ridiculed. Does the state of New Jersey have to place her in another school at our request, can we sue the school for not providing for her saftey.

Sexual harassment law has been applied to schools. That does not mean that the state of New Jersey has to place her in another school at your request. While there is an anti bullying law which provides for placement in another school, it is not very strong, and applies to districts, not the state of NJ. You should speak to a lawyer versed in either educational law, or the law of sexual harassment, or both. It is impossible to advise you without many more facts.
