Legal Question in Traffic Law in New Jersey

I was driving in the local lanes on the Garden state parkway when I was pulled over by NJ state police. He claims he was going 80mph in the Express lanes, and he saw me (which I was in the local lanes, passing all the cars) so he says I must have been doing 85mph. My question is: If this goes to trial can I argue that it was not possible he didn't loose sight of my car since he was express and I was in local? WHat other defense can I argue?

The State has to prove their case against you. Part of their proving their case is having the state trooper testify as to his observations of you driving. If you intend to go to trial, I would advise you to consult with a lawyer in person first and consider hiring one. Lawyers are generally trained to cross examine witnesses at trial. You really should not go to trial without an attorney. If you were charged with doing 85 in a 55 that ticket carries 5 points as well as a potential suspension.
