Legal Question in Traffic Law in New Jersey

Improper U-Turn

My mother was given a ticket through the mail for making a U-Turn. I was actually the driver at the time. The officer never actually stopped us. Furthermore, there was no traffic within 500 feet of the vehicle since it was a residential/business district at 12:00 am and there were no signs indicating a U-Turn cannot be done.

Is there a way my mother and I can fight the ticket? Thank you.

You are smarter than you know. There is a great defense. The u-turn statute requires a sign forbidding same and the ticket must be issued to the guity party within 30 days.

Actually there are two parts to the u turn statute. One part requires a u turn sign be conspicuously posted saying no u turn. The other section basically states that if you cannot see more than 500 feet in either direction if there is on comingv traffic like on a hill for example then a u turn is also not permitted. What u need to do is plead not Guilty and request a trial if you feel u are not Guilty. Tell the judge your position and the court will decide the matter. Good luck
