Legal Question in Traffic Law in New Jersey

up tp ho how many times can I reschedule a court appearance?

I live in NY and I have a court appearance for a ticket in Jersey. I had to resechedule twice because of school. I work full time and study full time. I called and wanted to know if I can please resechedule for maybe the following week and both people that I spoke to were of no help to me. I feel my reason for not being able to appear is reasonale and I was told to basically pick between paying it or a warrant. I don't feel it's right, I think certain things should be taken into consideration. Can you please let me know more about New Jersey law and my situation.

It completely depends pon yuour excuse and how many time that the matter has been postponed. It is up to the Court. The reason why they are difficult to deal with is because they have thousands of people trying to postpone cases. Everyone feels that they each have a good reason. The truth is, only the court decides the definition of "good reason"It is a pain in the necl going to these hhearings, but unfortunatly that is how traffic ticket justice is dished.

There is a rule in New Jersey Courts that allows someone from out of state or otherwise unable to appear to plead not guilty with an explanation by affidavit. Call the Court and ask them to send you the affidavit form. You then set forth your defense and have it notarized. The Court will then consider it in light of the officer's testimony.

I suggest you get an attorney. I've had clients with this situation before and I was able to get the warrant thrown out. I can't say that this will happen for sure, but I can say its been done.

Call me at 732/247/3340 to discuss your case. My initial consultations are always free.
