How to legally become a power of attorney etc.

My father died a couple years ago and before he died he changed the power of attorney on his will. He left everything to my mother after he died and to split everything else after my mother's death 50/50. Now my brother has put all of my mother's bank accounts, savings, retirement funds, SSI, and checking accounts in his name too. Is that legal? If so how would he go about doing that? Now he wants to sell her property or force me to buy his half from him. He is also getting the power of attorney notorized. Is that legal? He has also taken money out of many accounts and closed them down.

When your father died, his power of attorney ended. If your mother is still alive, she can sign a power of attorney if she is competent. It must be notarized to be valid. You should see an attorney with whatever papers you have to straighten this out. If you are in North Jersey, call our office and the first half hour is free if you mention this site. Good luck.
