Legal Question in Workers Comp in New Jersey

is worker compensation also leave of act...i have a 2 level fusion on my back in 2000 and i work at the hospital i injured my back at work on may of 2006 now before this injury i was doing fine no problem at all with my back but i was on worker comp i was recieveing my workers comp check every 2 week but they sent me a letter and it said leave of act is that the same? and are they suppose to cover all my medical? they had me use my insurance for my physical therapy and to go see the orthopedic doctor that done my surgery in 2000 they said they was not going to cover it because they said they wanted to make sure that it was not from my surgery but when i went to see my surgeon that performed my surgery he sent me for a ct scan and flexion ,extension x-ray and i also had an mri, all my test came back fine there was nothing wrong with the hardware on my back from my previous surgery and was told it was definately work related . now im back at work they release me to full duty is it late to do anything about my case

The Family and Medical Leave Act (FMLA) is not the same as workers compensation. If your company told you to use the FMLA then that means that you did not go through the workers compensaton system. Despite the fact that you had prior back surgery, you can still file a cliam for this new injury.
