my brother's case
is it right that if your arrest record only shows a misdemeanor crime that they can not arrest you on the same crime as a felony?

Yes, unless there are additional facts to support the felony as well. If this is the case, you need to contact an attorney to get to the bottom of it, sooner rather than later.
