can I go to jail for not having a public defender because can't afford a public defender

If you qualify on the basis of your income, you can obtain the services of a PD at no cost. PD's are provided to low-income people who need legal representation and cannot afford it. You can get an application for the PD from the courts or from the PD's office. You will not go to jail just because you don't have a PD, now or in the future. Whether or not you go to jail depends upon the outcome of your trial, or the terms of your plea agreement if you reach one. By all means contact the PD in your area and make application. They can be found in the blue pages of the phone book, or by calling the NM State Bar. Good luck.
