Legal Question in Family Law in New Mexico

I was divorced in May 2009. In the separation of assets we set asside $40,00 college fund for our children 18, 15. The money had been saved over our 21 year marriage. My son begins college next month, and I find my ex has cashed in the account and the money is gone. He now expects me to pay half of all costs beginning next month.. I earn $1,000 a month. Do I have legal recourse.

You certainly have legal recourse concerning any provisions of your divorce decree which have been violated by your ex. So does your 18 year-old. Consult a general practice attorney in your area for specifics. Recommendations are available through the State Bar of NM.
