Legal Question in Disability Law in New York

Social Security Discrimination

I work with an individual who receives SSI due to his diagnosis of Mental Retardation-he wants to marry a paralegal who will eventually like to become an attorney. She is telling him that she cannot marry a social security recipient because of a ''background check'' that attorneys and their spouses have to go through. I am asking for clarification as to whether or not this is a true statement so I can pass it onto this individual. She has not been able to specify if it is through the actual Bar Association that this check happens, or even prior to it. If I could have something from you in writing to pass along to him and to his family, I would greatly appreciate it. The whole thing appears strange to me, but that is why I am asking. Thank you for your time.

There are indeed background checks involved in being an attorney however, being married to an ssi recipient has never, as far as I know, been considered improper.

You either have misunerstood this, or it was not explained to you properly.

An attorney cannot have a felony conviction etc.

SSI is irrelevant.
