Legal Question in Disability Law in New York

Write ups at work

I just found out that I was pregnate and in the first two months of my pregnancy I got sick a couple of times. For which each time I brought in a docters note. HR wrote me up for exceeding my sick days although they knew I was pregnate and had docters notes. They wanted me to take a leave of absence. Can they do this?

Re: Write ups at work

Congratulation on the coming event.

This is an 'employment law' problem and, no, you cannot be required to take a leave of absence.

In addition, the employer is required to 'accomodate' you in your health challenges due to pregnancy.

The employer may not retaliate against you for taking sick days that you have earned.

You are welcome to a consultation for no fee.
