Legal Question in Appeals and Writs in New York

Split decision by Supreme Court

A case from the New York Court of appeals is appealed to the United States Supreme Court. The United States Supreme Court grants cert and after briefs and oral arguments votes 4 - 4 on that case. Does the New York Court of appeals decision stand or is it reversed?

The New York Court of Appeals decision would stand. A decision appealed to the U.S. Supreme Court stands unless it is reversed.
