Legal Question in Bankruptcy in New York

I am unemployed and cannot find employment. I claimed bankrupcy back in 2003 due to a nasty divorce. I have a surcharge in NewJersey due to Zanax wich is aolmost 4,000 plus medical bills. With the encony the way it is, I cannot get employment. Can i claim bankrupcy? i don't know what to do.

I assume that your prior bankruptcy was a Chapter 7 case.

Unfortunately, you cannot file another Chapter 7 bankruptcy for several more years. The actual time you must wait to be eligible for Chapter 7 again is 8 years from the date your prior petition was filed. That would probably be sometime in 2011.

However, you would be eligible to file for Chapter 13 right now. However, there is an issue as to whether it would be economically feasible for you to do so, considering the legal expense involved.

I suggest you meet with an attorney in your area to inquire further.
