Legal Question in Bankruptcy in New York

Bankruptcy and Divorce

I'm considering both Chapter 13 and Divorce in New York State. In what order should I pursue them or should they both be done together?

Re: Bankruptcy and Divorce

You have a simple question, but there is a complicated answer, dependant upon a number of factors that you didn't indicate. The only way to get proper guidance is to meet with a qualified bankruptcy attorney.

Please check out this link for an article about matrimonial issues and bankruptcy:

Re: Bankruptcy and Divorce

Are you expecting your spouse to request alimony or chgild support.

If so please note that bankruptcy does not excuse payments such as child support.

With this in mind you can file your actions simultaneously.

Sincerely,
