Legal Question in Bankruptcy in New York

Bankruptcy and tax return

I currently have an Automatic Stay in effect. The Ch. 7 paperwork was filed on the 22nd. I didn't have my 2008 W-2's at that time. The lawyer has 3 previous years worth. He said he wanted a copy of the 2008's when I get them. I will get them on the 30th.

Questions:

1. Will I *HAVE* to file?

2. If I do, will I lose all or part of my refund if I get one?

3. I was told I can have $2500 cash on hand after filing. Is a refund considered cash on hand?

Thank you.
