Legal Question in Bankruptcy in New York

liens and bankruptcy

I filed for bankrupty in 1996 and was discharged in 1997. I am attempting to refinance my house and there is a lien on the title from a company that was included in the bankruptcy. They had a judgement filed 3 months prior to the bankruptcy. I have always thought this was included in my chapter 7. Please let me know why it is appearing on my title and can it be removed

Re: liens and bankruptcy

If you listed the debt in your chapter 7 petition, then it should be lifted. Sometimes they don't do it themselves. This is an easy task to accomplish. You must petition the district court for an order to remove the lien. You are welcome to a consultation at no charge at my offices at 42 west 44th st., NY,NY. Please call for an appointment first.
