Legal Question in Bankruptcy in New York

Medical Claims

I was employed at an internet co. marchFIRST that went

bankrupt in April. It employed over 9,000 employees.

The office was still in operation until 5/28/01.

Monies were deducted for health insurance provider

Blue Cross/Blue Shield thru 5/28/01 until the office

closed. Blue Cross has said it never rec'd payment

from marchFIRST for the month of April. I had surgery

and have been denied eligibility for payment from Blue

Cross. I have the check stubs, memo's and a

certificate of group Health Plan Coverage from

marchFIRST (the Certificate of Credible Coverage

(HIPPA Certificate) stating date coverage ended as

4/30/01.

The more accurate question is what type of

notice of cancellation of the insurance

was given to you when the payments weren't

received. It is my belief that under such

policies there must be notice of cancellation

and the opportunity to get replacement

insurance. The failure to notify you of the

lack of payment could still obligate them

to pay. This is the tact I would originally

take. There is also the possiblity that

the failure to pay the funds by the company is

not dischargeable in bankruptcy. But this

is strictly secondary if coverage can be

forced on BL/Bs
